Important Notice Regarding Text Messaging Data

We do not share customer opt-in information, including phone numbers and consent records, with any affiliates or third parties for marketing, promotional, or any other purpose unrelated to providing our direct services. We do not share your opt-in data or consent records with third parties/affiliates for marketing/promotional purposes. All text messaging originator opt-in data is kept strictly confidential.

When you complete our inquiry form, book a consultation, or become a client, we may collect:

  • Which program you are interested in and how soon you would like to begin
  • How you heard about us, and the name of anyone who referred you

  • Mailing address, where we need to ship something to you — a laboratory collection kit, a printed meal plan book, or a product order

Health information

If you become a client, health information is collected as part of your clinical intake and laboratory testing. This information is collected and stored in our clinical systems, not in our marketing or website systems. See Section 4 for how we treat it.

When you visit our website, we may automatically collect:

  • Pages viewed and time spent on each

3. SMS and Text Messaging

SMS communication and consent

By providing your phone number and opting in through our website form, you consent to receive SMS messages from Lōkahi Holistic Healing. These messages may include responses to inquiries, appointment confirmations and reminders, scheduling updates, program-related updates, and optional marketing messages.

Message frequency varies. Message and data rates may apply. Reply STOP to opt out. Reply HELP for help, or contact us at info@lokahi.co.

We do not sell, rent, or share your phone number or SMS consent with third parties or affiliates for marketing purposes.

Two categories of consent

Our forms offer two independent SMS consent options. SMS consent is not a condition of purchasing any product or service from Lōkahi Holistic Healing.

  • Non-marketing (transactional) messages: responses to your inquiry, appointment confirmations and reminders, scheduling changes, laboratory and program updates, and payment notifications.
  • Marketing messages: information about programs, offers, events, and educational content.

Opt-out

You may opt out of receiving text messages at any time by replying STOP to any message you receive from us. You will receive a one-time confirmation message, after which no further messages will be sent from that category unless you re-opt in. You may also reply HELP for assistance or contact us at info@lokahi.co. All opt-out requests are processed immediately.

To rejoin, opt in again through our website form.

Age restriction

You must be 18 years or older to participate in our SMS program.

Carrier information and liability

Standard message and data rates may apply. Our SMS program works with all major U.S. wireless carriers, including AT&T, T-Mobile, Verizon, and most regional carriers. Wireless carriers are not liable for delayed or undelivered messages. Lōkahi is not responsible for messages not received due to carrier issues, device incompatibility, or changes to your mobile number or service plan.

Mobile information sharing

No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. Information sharing to subcontractors in support services, such as customer service, is permitted. All other use case categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties, excluding aggregators and providers of the text message service.

Our regulatory position, stated plainly

Lōkahi Holistic Healing operates as a direct-to-consumer practice. We do not bill insurance and we do not conduct electronic transactions with health plans. As a result, we are generally not a HIPAA covered entity, and the information we hold is not “Protected Health Information” as HIPAA defines it.

That does not mean your health information is unprotected. Health information held outside HIPAA is governed by consumer health data laws, the FTC Health Breach Notification Rule, and state privacy laws. We handle your information in accordance with those requirements, and the practices below apply regardless of which framework governs.

What we consider consumer health data

Information that identifies your past, present, or future physical or mental health status, including laboratory results, symptoms, health conditions, treatments, and any inference we could draw about your health from your interactions with us.

Where it lives, and where it does not

  • Clinical information lives in our clinical systems, which are purpose-built for that use and access-controlled.
  • Our website and customer relationship management system hold only your name, contact details, which program you are interested in, how soon you would like to begin, and how you heard about us.
  • We do not collect date of birth on our website form. We ask for an age range instead. Exact date of birth is collected later, in our clinical intake, where it is required for laboratory requisitions.
  • Laboratory results are never sent by email or text message. We will tell you that results are ready and invite you to schedule a review. The results themselves are discussed with you directly.

Consent

We collect consumer health data only with your consent, and only for the purposes you have consented to. Consent is requested separately and specifically — it is not bundled into acceptance of these terms or into any other agreement.

We do not sell your health data

We do not sell consumer health data. We do not share it for targeted advertising, and we do not use it for advertising purposes of any kind.

Your rights regarding health data

You may request to:

  • Confirm whether we are collecting, sharing, or selling your consumer health data
  • Access the consumer health data we hold about you
  • Receive a list of third parties with whom we have shared it
  • Have your consumer health data deleted
  • Withdraw your consent at any time

Who we share it with

Health information is shared only with those who need it to deliver your care:

  • The CLIA-certified laboratory that performs your testing
  • Our clinical records system, which stores your intake and results
  • Practitioners directly involved in your care

Each is bound by contractual confidentiality obligations. We do not share health information with advertising platforms, data brokers, or analytics providers.

5. Information Sharing and Disclosure

We do not sell, trade, or rent your personal information. We may share information only:

With service providers who assist in operating our business — including our customer relationship management platform, clinical records system, payment processor, email and SMS delivery providers, scheduling tools, and website analytics. All are contractually obligated to maintain confidentiality and security.

With our laboratory partner, solely to process your testing.

For legal compliance — where required by law, legal process, or a valid government request, or to protect the rights, property, or safety of Lōkahi, our clients, or others.

In a business transfer — in the event of a merger, acquisition, or sale of assets, in which case your information remains protected under the terms of this policy.

With your explicit consent.

All of the above exclude text messaging originator opt-in data and consent, which will not be shared with any third party other than the aggregators and providers of the text message service.

  1. Cookies and Tracking Technologies

We use cookies and similar technologies to analyze site traffic, remember your preferences, and improve site functionality.

Analytics. We use Google Analytics to understand how visitors find and use our website — which pages are viewed, how long visitors stay, and general geographic region. This helps us improve the site. It is not used to build advertising profiles.

Embedded video. Some sections of our site include video hosted by YouTube. When one of those pages loads, YouTube may set cookies on your device under its own privacy policy.

Accessibility. We use a third-party accessibility toolbar, which stores your display preferences so they carry over between visits.

We do not place advertising or retargeting trackers on our site, and we do not operate a Meta (Facebook) pixel. We consider information about someone browsing health services to be sensitive, and we do not pass it to advertising platforms.

You may control cookies through your browser settings. Disabling certain cookies may affect site functionality.

We implement reasonable administrative, technical, and physical safeguards to protect your information, including:

10. Minors

Our website is not directed to children, and we do not knowingly collect personal information from children through our website.

Laboratory testing services may be provided to minors when requested and consented to by a parent or legal guardian. Where we provide services to a minor, health information is collected through our clinical intake with the involvement and consent of the parent or guardian, and is handled under the protections described in Section 4.

Our SMS program is limited to individuals 18 years or older.

11. California Privacy Rights

If you are a California resident, the California Consumer Privacy Act provides additional rights:

  • Right to know the categories and specific pieces of personal information we have collected
  • Right to delete personal information we have collected, subject to certain exceptions
  • Right to non-discrimination for exercising your rights
  • We do not sell personal information as defined under the CCPA

Residents of states with comprehensive privacy or consumer health data laws — including but not limited to Washington, Nevada, Connecticut, Virginia, and Colorado — may have additional rights regarding their information, including rights specific to consumer health data. We extend the rights described in Sections 4 and 9 to all our clients regardless of residence. If you wish to exercise a right specific to your state, contact us and we will honor it.

As a Florida-based business, we comply with applicable Florida privacy law, including the Florida Digital Bill of Rights where applicable.
